This document is an official public offer (the "Offer") of Individual Entrepreneur Kovalchuk Dmytro Oleksiyovych, registered in Ukraine (RNOKPP 3582801257, registered address: 13 Bohdana Khmelnytskoho St., Bronnyky, Rivne Raion, Rivne Oblast, Ukraine) (the "Contractor"), addressed to any individual or legal entity (the "Customer") to enter into a contract for the provision of access to the Konspekt AI platform on the terms below. Acceptance of this Offer constitutes a binding agreement.
1. Acceptance
Full and unconditional acceptance of this Offer occurs when the Customer registers an account and/or makes a payment for any subscription plan. From that moment the Offer is deemed concluded as a contract under Articles 633, 641, and 642 of the Civil Code of Ukraine.
2. Subject of the Contract
The Contractor grants the Customer access to the functionality of the Konspekt AI platform (an AI-assisted tool for generating educational content, managing courses, and tracking learning), and the Customer pays for it under the chosen plan. The service is provided "as is" and "as available".
3. Price, Payment, Security, and Service Provision
- Prices for subscriptions are published on the Platform (pricing page) and may be changed by the Contractor for future billing periods. The amount payable is shown before you confirm the order.
- The settlement currency is US Dollars (USD). Applicable taxes (if any) are shown at checkout.
- Payment is made online by Visa or Mastercard bank card through the WayForPay payment service. The charge occurs at the moment the order is confirmed.
- Payment security: transactions are protected by 3D Secure; the payment service is PCI DSS certified. The Contractor does not receive or store full card details — only a masked card number and a token for recurring charges.
- For subscriptions, the Customer authorises automatic recurring charges at the chosen interval until cancellation, in accordance with the Terms of Service.
- Service provision: the service is electronic. Access to the paid functionality and/or credits is activated automatically immediately after successful payment. No physical goods are shipped.
4. Rights and Obligations
The Contractor undertakes to provide access to the paid functionality and reasonable support. The Customer undertakes to use the Platform in accordance with the Terms of Service and Acceptable Use Policy, to provide accurate information, and to pay the agreed fees.
5. Term, Refunds, and Termination
The contract is effective from acceptance until the Customer deletes their account or the parties terminate it. Refunds are governed by the Refund Policy. Either party may terminate as set out in the Terms of Service.
6. Liability and Force Majeure
The parties' liability is limited as set out in the Terms of Service. The Contractor is not liable for failures caused by circumstances beyond its reasonable control (force majeure), including third-party provider outages.
7. Personal Data
Personal data is processed in accordance with the Privacy Policy and the Law of Ukraine "On Protection of Personal Data". By accepting this Offer, the Customer consents to such processing.
8. Governing Law and Details
This Offer is governed by the laws of Ukraine. Contractor's details:
